Ex-Penn State president disputes sex abuse report

PHILADELPHIA (AP) ? Ousted Penn State President Graham Spanier and his lawyers attacked the university-backed report on the Jerry Sandusky sex abuse scandal on Wednesday, calling it a "blundering and indefensible indictment" as they fired a pre-emptive strike while waiting to hear if he'll be charged in the case.

Lawyer Timothy Lewis called Louis Freeh, the former FBI director and federal judge behind the report, a "biased investigator" who piled speculation on top of innuendo to accuse Spanier in a cover-up of early abuse complaints.

"The Freeh report, as it pertains to Dr. Spanier, is a myth. And that myth ... ends today," Lewis said at a downtown Philadelphia news conference.

Spanier did not attend, but he told media outlets in stories published hours later that he never understood the early complaints about Sandusky, who this year was convicted of molesting 10 boys and awaits sentencing, to be sexual.

"I'm very stunned by Freeh's conclusion that ? I don't think he used the word 'cover-up'; but he uses the word 'concealed,'" Spanier told The New Yorker magazine. "Why on earth would anybody cover up for a known child predator? Adverse publicity? For heaven's sake! Every day I had to make some decision that got adverse publicity."

The New Yorker interview was published online after ABC News began promoting its own interview with Spanier, set to air in parts on several of its networks Wednesday and Thursday.

At the news conference, Lewis, also a former federal judge, complained that Freeh never interviewed key witnesses, ignored inconvenient facts and manipulated the truth.

For instance, he said, the report assumes former graduate assistant Mike McQueary told coach Joe Paterno in 2001 that he saw something sexual in a locker room shower and that Paterno echoed that to athletic director Tim Curley and vice president Gary Schultz. Freeh likewise, he said, assumes that they in turn told Spanier the same thing.

"Curley and Schultz have denied that they ever told Dr. Spanier anything of the sort," Lewis said. "'Horseplay' was referred to over and over again, but never with any sexual connotation or suggestion of abuse. But Judge Freeh paid no attention to that."

The Freeh group said Wednesday that it stands by its report.

Its investigation uncovered documents that suggest Spanier had deeper knowledge of the early Sandusky complaints, including an email in which the president appeared to agree with Curley's decision to keep a 2001 assault from child-welfare authorities and instead work directly with Sandusky and Sandusky's charity for at-risk youths.

"The only downside for us is if the message isn't 'heard' and acted upon, and we then become vulnerable for not having reported it," said Spanier's email, dated Feb. 27, 2001. "The approach you outline is humane and a reasonable way to proceed."

Spanier's four high-profile lawyers, who are being paid by Penn State, argue that Freeh took the email out of context.

As for a 1998 report that Sandusky had showered with a boy ? a complaint that led to a campus police investigation referred to county prosecutors ? they note that prosecutors declined to charge Sandusky.

"There was thus nothing to conceal," the lawyers wrote in a rebuttal to the report released Wednesday.

Spanier and Paterno were ousted in November, days after Sandusky was charged. Curley and Schultz are charged with perjury and failing to report suspected child abuse; they maintain their innocence. Spanier's lawyers said they don't know whether he will be charged.

"That's out of our control," lawyer Jack Riley said.

A spokesman in the attorney general's office has declined to comment on possible charges, while calling the Sandusky probe "ongoing and active."

University trustee Anthony Lubrano, who attended the law firm news conference, said the board has never adopted Freeh's report, unlike current university President Rodney Erickson.

"I'd love for us to come out with a statement that says, we've never accepted this report," Lubrano said.

With Erickson's approval, the university has agreed to pay $60 million in NCAA fines over the scandal.

Spanier, who remains a tenured faculty member at Penn State, has told trustees he would never cover up abuse because he himself had been physically abused as a boy by his father, as a form of discipline.

"Someday I hope to have my name completely cleared when it becomes evident that this was unfair and untrue," Spanier told The New Yorker.

Chances are you?ve never heard of Oliver Starr. But you?ve probably heard of many of the people below:

This may seem odd to you, but Oliver, a successful blogger and Michael Arrington?s first employee at Tech Crunch, had never heard of these people when I mentioned their names. ?The only reason I learned who he was is because he?s the product evangelist for Pearltrees, a tool for organizing information that I really love.?My interaction with Oliver was eye-opening because I just assumed that if you?re in ?the biz? you would have heard of most of these folks.

It made me realize just how narrow our view of the web is.

A few weeks ago Mark Schaefer wrote about his observation that there is nothing new in blogging. I?m willing to bet if most of Mark?s readers put the names of the blogs they read on a regular basis into a hat, they would all have a very similar list. Our natural tendency is to gravitate towards people?similar?to us, and the result is a self-imposed lens through which we view the social web. ?Maybe it isn?t that there?s nothing new in blogging, but that we?ve been stuck in an incestuous circle of social media marketers, lifestyle designers, and personals development bloggers. Just so we?re clear, I?m not pointing fingers. I fall into those same incestuous circles!

Innovation and new ideas can?t diffuse throughout the social web when experts spend all their time talking to experts. That?s why I believe it?s important we not only embrace new and emerging talent, but also take steps to get outside of our comfort zone and expand our horizons. ?Here are five ideas on how to do that ?

1. Purge your blog reader and start from scratch

Every few months I literally unsubscribe from nearly every blog I read. This enables me to accomplish a few things.? First I?m able to prioritize which blogs have become the most important to me. ?Second, it forces me to look for new blogs and creates an opportunity to connect with new people. ?As a result my network continually expands.??Subscribe to a few blogs that have nothing to do with your industry but that you just find interesting.

2. Pick 5 new people to follow on Twitter and build a relationship with them

I?ve never particularly cared too much about the number of followers I have on Twitter which might seem sacrilegious, but it?s been a big part of my philosophy on building relationships. What I?m more interested in is who is actually following me.? Every few days I read the bios of my new followers and pick a few to engage with. ?The amazing people I?ve found by doing this include successful entrepreneurs, artists, published authors, literary agents, and many other people who are doing amazing things online. This has been a great way to broaden my own horizons and connect with exciting new people.

3. Attend a conference outside your industry

One of the best pieces of advice I ever received about leveraging public speaking was from Michael Port. He said that rather than speaking at a social media conference go speak to an association of dentists because in that environment you?ll be the go-to person on your subject matter. This could lead to additional speaking engagements and consulting opportunities. ?By attending or speaking conferences outside your industry, you not only have an opportunity to grow your network substantially, but you could also tap into a significant source of opportunities. Additionally you may find that you?ll be exposed to? a wide variety of new ideas.

4. Go to smaller conferences

Our general tendency is to attend the biggest industry conferences each year so we can see as many people as possible.? This creates a highly competitive environment for people?s attention and limits what we can get out of the conference.? I think conferences like Social Slam, which is devoted to opening up speaking and networking opportunities for diverse new talent, drives opportunities to meet thought leaders outside the echo chamber.?One additional suggestion I have for conferences ?? don?t hang out with the people you already know. ?Seems obvious, but not always easy to do.

5. Don?t go to conferences. Attend a retreat instead

A 5-minute conversation and business card exchange during happy hour at a conference has its limits in terms of building long-term relationships. This is why I think a 5-6 person retreat of some sort that involves more than just talking about business could be much more powerful than a typical conference. ?Imagine how well you?d get to know each other if a small group of people spent three or four days together.

If we?re going to discover what?s new in blogging and social media marketing, then we have to keep opening up ourselves to new people and new experiences by trying things we?ve never tried.

Stock slip after Japan data, Greece meetings eyed

Updated at 10:32 a.m. ET: Stocks eased Wednesday as weak export data from Japan underscored the headwinds facing the global economy, while Greece was beginning a series of meetings with European officials aimed at securing more time to push through reforms.

Japan's exports slumped the most in six months in July as shipments to Europe and China tumbled, adding to concerns over global demand after a string of dire trade figures from Asia's export engines.

Greek Prime Minister Antonis Samaras starts a European charm offensive with talks to persuade euro zone chief Jean-Claude Juncker that the debt-laden nation has the will to ram through unpopular reforms and deserves more time to do it.

Stocks have rallied over the summer partly on signs of strength in the U.S. economy and partly on the belief that the European Central Bank will act to prop up the euro zone. The Japanese data, while not undermining that thesis, did sound a note of caution.

"The way we've been looking at it in this kind of flat GDP growth environment for the world is that where there's a loser there's a winner, and recent manufacturing data in the U.S. has been surprisingly strong overall so there is going to be a loser on the flip side," said Oliver Pursche, president at Gary Goldberg Financial Services in Suffern, New York.

In economic news, a report showed More Americans purchased previously-owned homes in July, suggesting improvement in the beleaguered housing market over the summer.

Later, the Federal Reserve releases minutes from its July-August meeting at 2:00 p.m. ET. Investors will parse them for signs that members are moving closer to new stimulus measures or conversely toward raising interest rates sooner than expected.

Toll Brothers Inc , the largest luxury homebuilder in the United States, reported a higher quarterly profit and a sharp jump in new orders amid a recovery in the housing market.

Dell Inc - The No. 2 U.S. PC maker - warned of a challenging second half and slashed its full-year earnings outlook as customers cut back on computer purchases ahead of the launch of Microsoft's Windows 8 software.

The S&P 500 hit a four-year intraday high on Tuesday before reversing gains and finishing in negative territory in a sign the index could struggle at these higher levels without new catalysts. Some investors are also worried about the potential for a swift reversal as has happened in the recent past.

"Is something going to happen over the next couple of days or weeks that continues this pattern we've had that every time we get up to this level it's not sustainable," said Paul Mendelsohn, chief investment strategist at Windham Financial Services in Charlotte, Vermont.

European shares fell on Wednesday. Cyclical stocks led the decline on growth concerns fueled by the weak export data from Japan. But expectations of more stimulus measures by central banks capped losses.

The euro fell to a session low against the dollar as some investors took profit on the single currency's rally to a seven-week high the previous day.
